CODE OF FEDERAL REGULATIONS – TITLE 40 Protection of Environment – CHAPTER I–ENVIRONMENTAL PROTECTION AGENCY — SUBCHAPTER C–AIR PROGRAMS: PART 98–MANDATORY GREENHOUSE GAS REPORTING หรือ “40 CFR 98”

สิ่งแวดล้อมและการเปลี่ยนแปลงสภาพภูมิอากาศ (Climate Change)

วัตถุประสงค์และขอบข่ายการบังคับใช้กฎหมาย 40 CFR 98:

(1)   เป็นข้อกำหนดการรายงานก๊าซเรือนกระจกซึ่งเป็นการบังคับตามกฎหมาย สำหรับเจ้าของและผู้ปฏิบัติงาน (Owners and Operators) ของกิจกรรมต่างๆ (Certain Facilities) ที่มีการปล่อยก๊าซเรือนกระจกโดยตรง เช่น จากเชื้อเพลิงฟอสซิลของผู้ส่งมอบ (Certain Fossil Fuel Suppliers) หรือกิจกรรมของผู้ส่งมอบที่มีการปล่อยก๊าซเรือนกระจก (Industrial GHG Suppliers) เป็นต้น ทั้งนี้ สำหรับผู้ส่งมอบ การรายงานก๊าซเรือนกระจกต้องครอบคลุมถึงปริมาณก๊าซเรือนกระจกที่มีการปล่อยจากการเผาไหม้ (Combustion) หรือการใช้ในกิจกรรมอื่นๆ ที่เกี่ยวข้องกับการส่งมอบสินค้า (Use of the products supplied)

(2)   เจ้าของและผู้ปฏิบัติงาน (Owners and Operators) ของกิจกรรมและผู้ส่งมอบที่เกี่ยวข้องตามข้อกำหนดทั้งหัวข้อหลัก (Part) และหัวข้อย่อย (Subpart) ทั้งนี้ ในกรณีที่มีข้อโต้แย้งระหว่างเงื่อนไขในหัวข้อใดๆ ให้ถือข้อกำหนดการปฏิบัติ (Requirements of the applicable) ที่ระบุไว้ในหัวข้อย่อย (Subpart) เป็นสำคัญ
